Élan Terms of Use (EULA)

These Terms govern your use of the Élan app and service ("Élan"), provided by Avora labs LLC ("we," "us"). By downloading or using Élan, you agree to these Terms. If you do not agree, do not use Élan.

1. Who can use Élan

You must be at least 18 years old and able to form a binding contract. Élan is a tool for adults using dating apps.

2. What Élan does

Élan suggests replies and openers based on a screenshot of a conversation you choose to analyze. Suggestions are generated by an AI system and are provided as drafts. You decide what to send. You are solely responsible for the messages you send and for how you interact with other people.

3. Acceptable use

You agree not to use Élan to:

  • harass, threaten, deceive, defraud, or impersonate anyone;

  • generate sexual content involving minors, or content that is illegal, hateful, or that promotes violence;

  • solicit or groom minors, or facilitate any abusive or non-consensual conduct;

  • violate the terms of any dating app or platform where you use the suggestions;

  • attempt to break, overload, reverse engineer, or abuse the service, or access it other than through the app.

We may suspend or terminate access for violations.

4. AI-generated content

Suggestions are produced by automated systems and may be inaccurate, generic, or inappropriate for your situation. We do not guarantee any outcome. Review every suggestion before using it. Do not rely on Élan for advice of any kind beyond casual conversation drafting.

5. Subscriptions and billing

Élan offers auto-renewing subscriptions with a monthly usage allowance (suggestions per month). Pricing is shown in the app.

  • Payment is charged to your Apple Account at confirmation of purchase.

  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the period end.

  • Manage or cancel anytime in Settings → Apple Account → Subscriptions. Deleting the app does not cancel a subscription.

  • Allowances reset each billing period and do not roll over.

  • Top-ups are a one time purchase, not a subscription. Top-up credits are added to your account, carry over between billing periods, and are used only after your monthly allowance is spent.

  • Refunds are handled by Apple under the App Store terms.

6. Your content

You retain any rights you have in the screenshots and text you submit. You grant us a limited license to process that content solely to provide suggestions to you. We do not store your screenshots after generating a response (see the Privacy Policy).

7. Privacy

Our handling of data is described in the Privacy Policy at https://www.avoralabs.net/elan/privacy, which is part of these Terms.

8. Disclaimers

Élan is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that suggestions will be accurate, appropriate, or lead to any result.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of Élan or the messages you choose to send. Our total liability for any claim is limited to the amount you paid for Élan in the twelve months before the claim.

10. Changes

We may update Élan and these Terms. Continued use after changes take effect means you accept the updated Terms.

11. Termination

You may stop using Élan at any time. We may suspend or end access if you violate these Terms or to protect the service.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules.
